A person registering for an Account or making a Purchase represents that:

(a) the person is legally competent to enter into the transaction; or

(b) where legally permitted, the transaction has been undertaken by or with the authorization of the person’s parent or lawful guardian.

We may refuse, restrict, or cancel access where information concerning age, identity, authorization, or eligibility is materially false or cannot reasonably be verified.

Certain Services may require registration.

You are responsible for the security and confidentiality of your login credentials.

An Account is personal to the registered User unless we expressly authorize another arrangement.

You must not sell, rent, sublicense, lend, transfer, share, or otherwise permit another person to use your Account or purchased access.

You must promptly notify us through our official contact channel if you reasonably suspect unauthorized access, compromise, or misuse of your Account.

We may restrict or suspend an Account where reasonably necessary to protect the User, our Services, other Users, our Content, or our legal rights.

7. Personal Use and Limited Access License

Where a Product is purchased, we grant the Customer a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Product solely for the Customer’s personal educational purposes during the applicable access period.

Unless expressly stated otherwise on the relevant Product page:

(a) access does not transfer ownership of any Content;

(b) Access is personal and cannot be commercially exploited;

(c) access cannot be transferred to another person;

(d) No right is granted to reproduce, redistribute, resell, publicly perform, publicly display, publish, adapt, translate, create derivative works from, or commercially exploit the Content.

8. Educational Services

Our Services are intended to support learning, examination preparation, and academic or professional development.

We aim to provide useful, accurate, and reasonably maintained educational Content. However, examination syllabi, rules, schedules, eligibility requirements, recruitment notices, answer keys, results, and other information may change or be determined by the relevant examination or recruiting authority.

Users should independently verify official examination notifications, eligibility requirements, deadlines, schedules, results, and other authoritative information with the relevant authority.

Our Services do not constitute a representation or guarantee that a User will obtain any particular rank, score, qualification, admission, appointment, employment, promotion, scholarship or other outcome.

9. Examination and Selection Disclaimer

Purchasing or using our Services does not create any promise or guarantee of:

(a) qualifying an examination;

(b) obtaining a particular score or rank;

(c) selection in a recruitment process;

(d) admission to any institution;

(e) employment or appointment; or

(f) success in any specific examination or career outcome.

Any testimonials, rankings, examples, historical results, or user experiences displayed on the Website are illustrative and do not constitute a guarantee of similar results for every User.

10. Product Information

We attempt to describe Products accurately, including, where applicable, their contents, access period, language, format, features, and pricing.

Specific Product pages, order pages, invoices, or purchase confirmations may contain additional terms relating to the relevant Product. Where such information is expressly stated for a particular Product, those Product-specific conditions shall apply to that Product in addition to these Terms.

If a Product page specifies a validity period, number of attempts, mentorship schedule, download facility, update period, or other material feature, the stated Product-specific terms shall control that feature.

11. Prices, Payments, and Taxes

Prices shall be displayed on the Website or relevant purchase page.

You agree to pay the applicable amount displayed at the time of purchase.

Payments may be processed through third-party payment service providers. Additional terms of the applicable payment provider may apply to the payment transaction.

Where an applicable tax, levy, or statutory charge is required by law to be collected or charged, it may be reflected in the applicable price, invoice, or transaction.

Our GST status may change as the Business grows or as Applicable Law requires. Nothing in these Terms should be interpreted as a permanent representation regarding GST registration or tax treatment.

12. Payment Failures and Duplicate Payments

If a payment fails, is reversed, is interrupted, or remains pending, access may not be provided until the transaction is successfully reconciled.

Where the Customer’s account has been debited but the payment has not been successfully confirmed by us, the matter will be investigated using the transaction information available from us and the payment provider.

Duplicate successful payments for the same Product may qualify for refund in accordance with our Refund & Cancellation Policy.

13. Offers, Discounts, and Coupons

Promotional offers, coupons, discounts, and special pricing may be subject to specific conditions, eligibility criteria, validity periods, usage limits, or restrictions stated at the time of the offer.

Unless expressly stated otherwise, promotional benefits are not transferable and cannot be exchanged for cash.

We reserve the right to withdraw or modify an offer, where permitted by law, including in cases of technical error, misuse, fraud, or unauthorized exploitation.

14. Subscriptions and Recurring Payments

Where subscription-based Services are offered, the applicable Product page or subscription terms will specify the subscription period, renewal conditions, pricing, and cancellation mechanism.

Where a recurring payment arrangement is enabled, cancellation of future renewals must be completed using the mechanism provided by the applicable payment provider or by us.

Cancellation of a recurring subscription prevents future renewals but does not automatically issue a refund for any period already purchased, except as required by applicable refund terms or law.

15. Course and Test Access

Access to courses, tests, and related Content is governed by our separate Course/Test/Content Access Policy, which forms part of these Terms.

Access may expire at the end of the validity period specified for the relevant Product.

Access may also be subject to reasonable technical, security, device, or usage restrictions.

16. Account Sharing and Unauthorized Access

Account sharing is prohibited unless expressly permitted in writing.

We may use reasonable technical and administrative measures to detect patterns reasonably suggesting unauthorized sharing, resale, credential misuse, excessive simultaneous sessions, automated extraction, or other misuse.

Where misuse is reasonably established, we may restrict, suspend, or terminate access, subject to Applicable Law and the Customer’s rights.

17. Intellectual Property

All intellectual-property rights in and to the Website, Content, branding, materials, software, databases, course structure, original questions, explanations, videos, graphics, logos, and other materials created or lawfully licensed by us remain with HITESHPANDEY.IN or the respective rights holder.

Your rights are limited to the license expressly granted to you.

Intellectual-property matters are additionally governed by our Copyright & Intellectual Property Policy.

18. User Content and Feedback

Where the Website permits reviews, comments, feedback, questions, testimonials, or other User Content, you represent that your submission:

(a) is accurate to the best of your knowledge, where it purports to state facts;

(b) does not knowingly infringe the rights of another person;

(c) does not contain unlawful, threatening, abusive, defamatory, obscene, or malicious material; and

(d) does not contain another person’s personal information without lawful authorization.

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, display, and use that User Content for operating, improving, promoting, and communicating about our Services, subject to Applicable Law.

We may moderate, remove, or restrict User Content that violates these Terms or Applicable Law.

19. Third-Party Services

The Website may use or link to third-party services, including payment processors, hosting providers, video providers, communication services, analytics services, or external websites.

Those third parties may have their own terms and privacy policies.

We are not responsible for the independent acts, omissions, availability, security, or policies of third-party services except to the extent required by law.

20. Content Updates and Corrections

We may update, revise, replace, correct, supplement, or remove Content from time to time.

Updates may be made to reflect changes in examination patterns, syllabus, laws, facts, errors, technology, or educational requirements.

Unless expressly promised for a particular Product, an update does not automatically create a right to an extension or refund.

Where a significant change materially affects a purchased Service, we may provide appropriate notice or a remedy as reasonably required.

21. Website Availability

We seek to keep the Website and Services reasonably available, but do not guarantee uninterrupted or error-free operation.

Temporary unavailability may occur due to:

(a) maintenance;

(c) software or hardware failures;

(d) third-party service interruptions;

(e) cyber incidents;

(f) power or connectivity problems;

(g) force majeure events; or

(h) circumstances beyond our reasonable control.

We will take reasonable steps to restore Services after material disruptions.

(b) deceive or impersonate another person;

(c) transmit malware or harmful code;

(d) harass or threaten another person;

(e) publish unlawful or infringing material;

(f) abuse examination systems;

(g) cheat, manipulate, or interfere with test functionality;

(h) exploit technical vulnerabilities;

(i) redistribute paid Content;

(j) create unauthorized commercial courses using our Content; or

(k) engage in any activity that violates Applicable Law.

23. Suspension and Termination

We may suspend or terminate access where reasonably necessary due to:

(a) material breach of these Terms;

(b) unlawful activity;

(c) payment fraud;

(d) account sharing or resale;

(e) intellectual-property infringement;

(f) cyber-security concerns;

(g) abusive conduct; or

(h) other serious misuse of the Website or Services.

Where practical and legally appropriate, we may provide notice and an opportunity to remedy a breach before termination.

Termination does not extinguish rights or obligations that by their nature should survive termination, including intellectual property, payment, liability, dispute resolution, and applicable legal obligations.

24. Refunds and Cancellations

Refunds and cancellations are governed by our Refund & Cancellation Policy.

Nothing in these Terms is intended to exclude or restrict any non-waivable rights available to a consumer under Applicable Law.

25. Disclaimers

To the maximum extent permitted by Applicable Law, the Website and Services are provided on an “as available” basis.

We do not guarantee that every item of Content will always be complete, current, error-free, or suitable for every User’s particular circumstances.

We do not warrant that the Website will always be uninterrupted, secure, or free of technical defects.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

26. Limitation of Liability

To the maximum extent permitted by Applicable Law, we shall not be liable for indirect, incidental, special, exemplary or consequential loss arising solely from a User’s use of the Website or Services.

To the extent permitted by law, any liability directly attributable to a paid Service shall ordinarily be limited to the amount actually paid by the relevant Customer for that Service.

This clause shall not be interpreted to exclude or limit liability to the extent such exclusion or limitation is prohibited by Applicable Law.

27. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Hiteshpandey.in from claims, losses, liabilities, costs, or reasonable expenses arising from your unlawful use of the Website, material breach of these Terms, infringement of another person’s rights, fraud, or misuse of the Services.

This indemnity shall not apply to the extent a claim results from our own unlawful conduct or from liability that cannot legally be shifted to you.

28. Privacy

Personal data is handled in accordance with our Privacy Policy, which forms part of these Terms.

29. Changes to These Terms

We may modify these Terms from time to time to reflect changes in our Services, technologies, business practices, or Applicable Law.

The latest version will be published on the Website with a revised “Last Updated” date.

Where Applicable Law requires a particular form of notice or consent for a material change, we will follow that requirement.

30. Governing Law and Jurisdiction

These Terms are governed by the laws of India.

Subject to applicable consumer-protection rights, statutory remedies, and the jurisdiction of competent consumer fora or authorities, disputes arising from these Terms shall be subject to the jurisdiction of the competent courts in Uttarakhand.

Nothing in this clause prevents a consumer from exercising a statutory right to approach a competent consumer commission, authority, or other forum where such right is available under Applicable Law.

31. Severability

If any provision of these Terms is held invalid, unlawful, or unenforceable, the remaining provisions shall continue to the extent permitted by law.

32. Waiver

Failure by us to enforce a provision on one occasion does not constitute a permanent waiver of that provision.

33. Entire Agreement

These Terms, together with the policies expressly incorporated into them and any applicable Product-specific terms, constitute the terms governing your use of the Website and Services.
